{"id":2680,"date":"2023-04-28T15:22:33","date_gmt":"2023-04-28T20:22:33","guid":{"rendered":"https:\/\/www.gcbloomrisk.com\/landing\/?p=2680"},"modified":"2023-06-27T10:06:37","modified_gmt":"2023-06-27T15:06:37","slug":"poder-de-representacion-a-traves-de-mensaje-de-datos","status":"publish","type":"post","link":"https:\/\/www.gcbloomrisk.com\/landing\/poder-de-representacion-a-traves-de-mensaje-de-datos\/","title":{"rendered":"<strong>PODER DE REPRESENTACI\u00d3N A TRAV\u00c9S DE MENSAJE DE DATOS<\/strong>"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>El poder de representaci\u00f3n se refiere a la capacidad de los abogados para actuar en nombre de sus clientes dentro de un proceso judicial o extrajudicial, representando sus intereses, derechos, y haciendo valer sus pruebas y argumentos ante las autoridades competentes.<\/p>\n\n\n\n<p>En correspondencia con la sentenciaSTC3134-2023 emitida por la Corte Suprema de Justicia en Sala de Casaci\u00f3n Civil, se reconoce la validez del poder brindado a trav\u00e9s de mensaje de datos, donde resaltan el deber de los administradores de justicia por procurar el uso de las tecnolog\u00edas de la informaci\u00f3n y la comunicaci\u00f3n (TIC) en la actividad judicial (regla 95 de la Ley Estatutaria de la Administraci\u00f3n de Justicia -n.\u00b0 270- y primer p\u00e1rrafo del canon 103 del C\u00f3digo General del Proceso), dejando claro que, se permite que el poder sea conferido por mensaje de datos sin requisitos innecesarios adicionales.<\/p>\n\n\n\n<p>As\u00ed mismo, la Corte manifiesta que por el concepto \u201cmensaje de datos\u201d no puede entenderse solamente la informaci\u00f3n remitida a un destinatario (correo electr\u00f3nico), sino que debe acogerse el sentido legal que le otorga el literal a) del art\u00edculo 2\u00ba de la ley 527 de 1999: informaci\u00f3n generada, enviada, recibida, almacenada o comunicada con un soporte electr\u00f3nico, digital, \u00f3ptico o similar.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><a href=\"https:\/\/www.gcbloomrisk.com\/landing\/wp-content\/uploads\/2023\/04\/CSJCSC3134-2023-2-PODER-JUDICIAL-A-TRAVES-DE-MENSAJES-DE-DATOS.pdf\" target=\"_blank\" rel=\"download noopener\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.gcbloomrisk.com\/landing\/wp-content\/uploads\/2023\/02\/boton_descargar.png\" alt=\"\" class=\"wp-image-2239\" width=\"252\" height=\"51\" srcset=\"https:\/\/www.gcbloomrisk.com\/landing\/wp-content\/uploads\/2023\/02\/boton_descargar.png 352w, https:\/\/www.gcbloomrisk.com\/landing\/wp-content\/uploads\/2023\/02\/boton_descargar-300x61.png 300w\" sizes=\"(max-width: 252px) 100vw, 252px\" \/><\/a><\/figure>\n","protected":false},"excerpt":{"rendered":"<p>El poder de representaci\u00f3n se refiere a la capacidad de los abogados para actuar en nombre de sus clientes dentro de un proceso judicial o extrajudicial, representando sus intereses, derechos, y haciendo valer sus pruebas y argumentos ante las autoridades competentes.<\/p>\n","protected":false},"author":3,"featured_media":2681,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_joinchat":[]},"categories":[16,18,19,22,29],"tags":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.1 -
